FreshScan Terms of Service

Welcome to FreshScan! These Terms of Service ("Terms") govern your access to and use of the FreshScan mobile application, website, and related services (collectively, the "Service"). By using FreshScan, you agree to these Terms. If you do not agree, please do not use the Service.
1. Overview
FreshScan provides tools to help users manage grocery lists, scan products, match deals, track pantries, and access smart shopping features. These Terms apply to all users, including household members and guests.
2. Eligibility
To use FreshScan, you must:
- Be at least 13 years old
- Create an account with accurate information
- Comply with these Terms and all applicable laws
If you are under 18, you may use the Service only with permission from a parent or guardian.
3. Your Account
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Ensuring your information is accurate and up to date
You may delete your account at any time. See our Data Deletion Policy for details.
4. Household Membership
FreshScan allows users to create or join households for shared access to lists, pantries, and premium features.
4.1 Household Owner
The Household Owner controls billing, invitations, and household settings.
4.2 Household Members
Members may access shared features but cannot manage billing.
4.3 Limited Members
Limited Members have restricted access and cannot manage household settings.
4.4 Leaving a Household
If you leave a household:
- You retain your personal data
- You lose access to shared lists and premium features unless you subscribe independently
5. Premium Subscriptions
FreshScan offers optional paid subscriptions, including monthly, annual, and lifetime plans.
5.1 Billing
Subscriptions are billed through Stripe, our payment processor. By subscribing, you authorize Stripe to charge your selected payment method for the full amount of your chosen plan.
5.2 Renewals
Monthly and annual subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. The lifetime plan is a one-time payment and does not renew.
5.3 Cancellations
You may cancel your subscription at any time through the app's "Change my Subscription" option in your Profile settings.
When you cancel:
- Your subscription remains active until the end of your current billing period
- You retain full access to all Premium features until that date
- Your subscription will not renew, and you will automatically move to the Free plan when the period ends
5.4 Refunds
All payments are non-refundable, and FreshScan does not offer pro-rated refunds for partially used billing periods.
- If you cancel mid-cycle, you keep access until the end of the period you already paid for, but no refund is issued for the remaining time
- Lifetime plan purchases are final and non-refundable
If you believe you were charged in error, please contact FreshScan support and we will review your case.
6. Acceptable Use
You agree not to:
- Use FreshScan for unlawful purposes
- Attempt to access accounts or data that are not yours
- Interfere with the operation of the Service
- Upload harmful, misleading, or inappropriate content
We may suspend or terminate accounts that violate these Terms.
7. Intellectual Property
All FreshScan content—including logos, designs, features, and branding—is owned by FreshScan and protected by copyright and trademark laws.
You may not:
- Copy, modify, or distribute FreshScan content
- Reverse engineer or attempt to extract source code
- Use FreshScan branding without written permission
8. User Content
You may upload or create content such as lists, pantry items, and scanned data.
By using the Service, you grant FreshScan a limited license to:
- Store your content
- Process it to provide app features
- Display it to your household members (if shared)
You retain ownership of your content.
9. Third‑Party Services
FreshScan may integrate with third‑party tools such as:
- Retailer APIs
- Loyalty programs
- Analytics providers
- Gmail connector for email integration
- Mobile API for app and device connectivity
FreshScan is not responsible for third‑party services or their privacy practices.
10. Disclaimers
FreshScan is provided on an "as is" and "as available" basis.
We do not guarantee:
- Accuracy of product data
- Availability of deals or savings
- Error‑free operation
- Continuous uptime
You use the Service at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, FreshScan is not liable for:
- Loss of data
- Inaccurate product or pricing information
- Damages resulting from use or inability to use the Service
- Household disputes or shared data issues
Our total liability will not exceed the amount you paid for the Service in the past 12 months.
12. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Misuse the Service
- Engage in fraudulent or harmful behavior
You may stop using FreshScan at any time.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will:
- Update the "Last updated" date
- Notify you of significant changes through the app or website
Continued use of FreshScan means you accept the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict‑of‑law principles.
